Welcome to DogPhotoAI! These Terms of Service ("Terms") govern your use of the DogPhotoAI website at www.dogphotoai.com and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use the Service.

1. Description of Service

DogPhotoAI provides an AI-powered pet photo studio that transforms your dog's photos into artistic portraits using advanced generative AI technology. The Service includes:

  • AI-powered portrait generation in multiple artistic styles
  • A Credits-based payment system for accessing generations
  • Account management via Google OAuth
  • Photo upload, processing, and download capabilities

The Service uses artificial intelligence to generate and modify image content. AI-generated results may vary, and we cannot guarantee specific outcomes for every generation. You are solely responsible for your use of the Service, including the photos you upload and the content you generate.

2. Account Registration

To use the Service, you must sign in with a valid Google account. By registering, you represent that:

  • You are at least 13 years of age
  • The information you provide is accurate and current
  • You are authorized to use the Google account you provide

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

3. Credits System

DogPhotoAI uses a virtual currency called "Credits" to access AI portrait generation features.

  • Credits are purchased through the Service using Stripe
  • Each AI portrait generation costs a set number of Credits (currently 5 Credits per generation)
  • Credits do not expire as long as your account remains active
  • Credits have no cash value outside of the Service

Refund Policy

Unused Credits are eligible for a refund under the following conditions:

  • Refund requests must be submitted in writing to support@dogphotoai.com within 14 days of purchase
  • Refunds are only issued for Credits that have not been used for any generation
  • Once any Credits from a purchased package have been used (even partially), the entire package becomes non-refundable
  • Refunds will be processed to the original payment method within 14 business days of approval
  • We reserve the right to deny refund requests that appear fraudulent or abusive

4. User Content

When you upload photos to the Service ("User Content"), you represent and warrant that:

  • You own or have the rights to the photos you upload
  • The photos do not infringe upon the intellectual property rights, privacy rights, or other rights of any third party
  • You have the consent of any identifiable individuals appearing in the photos (if applicable)

By uploading User Content, you grant DogPhotoAI a limited, non-exclusive, royalty-free license to use, process, and store your photos solely for the purpose of providing the Service to you.

We do not use your uploaded photos to train AI models or for any purpose beyond generating the portrait you requested.

5. Prohibited Uses

You agree not to use the Service to:

  • Upload harmful content: Photos that are illegal, obscene, defamatory, or infringe upon third-party rights
  • Violate others' privacy: Upload photos of individuals without their consent
  • Abuse the Credits system: Attempt to manipulate, hack, or exploit the Credits system
  • Reverse engineer: Attempt to decompile, disassemble, or derive the source code of the Service
  • Unauthorized access: Attempt to gain unauthorized access to our systems or other users' accounts
  • Spam or misuse: Use the Service for unsolicited communications or automated abuse
  • Violate laws: Use the Service for any illegal purpose under applicable laws

Violation of these prohibited uses may result in immediate account suspension or termination.

6. Intellectual Property

DogPhotoAI's Rights

The DogPhotoAI website, software, design, logos, and brand materials are owned by or licensed to DogPhotoAI and are protected by intellectual property laws. You may not copy, modify, or redistribute these materials without written permission.

Your Generated Portraits

AI-generated portraits created using your photos and our Service belong to you. You may download, share, and use them for personal and commercial purposes, subject to the limitations of the AI models used and applicable laws.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. DOGPHOTOAI DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

  • The Service will be uninterrupted or error-free
  • AI-generated results will meet your specific expectations
  • The Service will be free from viruses or other harmful components

8. Limitation of Liability

IN NO EVENT SHALL DOGPHOTOAI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR INABILITY TO GENERATE A PORTRAIT. DOGPHOTOAI'S TOTAL LIABILITY FOR ANY CLAIMS SHALL BE LIMITED TO THE AMOUNT YOU PAID FOR THE CREDITS GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless DogPhotoAI and its team from any claims, liabilities, damages, costs, and expenses arising from:

  • Your use of the Service
  • Your uploaded photos or generated content
  • Your violation of these Terms or applicable laws

10. Termination

DogPhotoAI may suspend or terminate your account at any time for violation of these Terms or suspected fraudulent activity. Upon termination, your right to use the Service will immediately cease. Unused Credits may be refunded at our discretion in accordance with our Refund Policy.

11. Governing Law

These Terms shall be governed by applicable law. Any disputes arising from these Terms shall be resolved in good faith. If resolution is not possible, disputes shall be subject to binding arbitration.

12. Changes to Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.
